Shipping Agreement

This Shipping Agreement (the "Agreement") is entered into by and between Grounds & Rounds LLC, a limited liability company organized under the laws of Georgia, with its principal place of business at Richmond Hill, GA (hereinafter referred to as the "Company"), and the individual or entity engaging the Company's services for the shipment of firearms, ammunition, or related items (hereinafter referred to as the "Customer").

By utilizing the Company's shipping services, the Customer agrees to be bound by the terms and conditions set forth in this Agreement. This Agreement is designed to ensure full compliance with all applicable federal, state, and local laws, including but not limited to regulations promulgated by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), the United States Postal Service (USPS), and common carriers such as UPS and FedEx.

1. Purpose and Scope

The Company provides shipping services for firearms, ammunition, accessories, and related items in strict adherence to federal law under Title 18 U.S.C. Chapter 44 (Commerce in Firearms and Ammunition) and associated regulations in 27 CFR Parts 478 and 479. All shipments must comply with ATF guidelines, which mandate that modern firearms be shipped only to holders of a valid Federal Firearms License (FFL). The Company will not provide its FFL/SOT to the Transferee but only to another FFL. All items will be shipped in standard packaging prepared and wrapped adequately. Grounds & Rounds LLC will not be liable for any mishaps during the shipping process or receiving process. A tracking number will be provided to the Customer as soon as possible to the email provided in the Customer's profile. The Company reserves the right to refuse any shipment that does not meet these requirements or poses a risk of non-compliance.

Violation of federal firearms shipping laws is a felony, with severe penalties including fines and imprisonment. The Company strongly recommends that Customers consult with a licensed FFL dealer when in doubt.

2. Definitions

• Modern Firearm: Any firearm manufactured after 1898 that does not qualify as an antique under 18 U.S.C. § 921(a)(16).

• Antique Firearm: A firearm manufactured in or before 1898, or a replica thereof, that meets ATF criteria for antiques (e.g., not using fixed ammunition or using ammunition no longer commercially available).

• FFL Holder: A person or entity holding a valid Federal Firearms License issued by the ATF.

• Nonlicensee: Any individual or entity without an FFL, considered an unlicensed person under federal law.

• Handgun: Any firearm capable of being concealed on the person, including pistols, revolvers, short-barreled shotguns, and short-barreled rifles, as defined by 18 U.S.C. § 921(a)(30).

• Long Gun: Rifles and shotguns not classified as handguns.

• Ammunition: Cartridges, shells, or projectiles designed for use in firearms.

• Carrier: A common or contract carrier such as UPS, FedEx, or USPS.

3. Shipping Requirements for Modern Firearms

All modern firearms must be shipped to a valid FFL holder. The Company will not provide its FFL/SOT to the Transferee but only to another FFL. The Company will not ship modern firearms directly to non-FFL holders, except in limited circumstances permitted by law (e.g., intra-state shipments between nonlicensees where allowed).

3.1 Nonlicensee Shippers

If the Customer is a nonlicensee:

• Modern firearms may only be shipped to an FFL holder in any state for legal purposes, such as sale, repair, or transfer.

• The Customer must provide the Company with a signed copy of the recipient FFL holder's license prior to shipment. The shipping address must match the address on the FFL.

• Handguns must be shipped via a common or contract carrier (not USPS).

• Long guns may be shipped via USPS to an FFL holder or intra-state resident, but the Company recommends using registered mail with no external markings indicating contents.

3.2 FFL Holder Shippers

If the Customer holds a valid FFL:

• Firearms may be shipped to other FFL holders or, in limited cases, nonlicensees within the same state.

• The Company will only share its FFL/SOT with another FFL holder.

• For USPS shipments of handguns, the Customer must complete USPS Form PS 1508 and file it with the local post office.

All firearms must be shipped unloaded, in standard packaging prepared and wrapped adequately, and the carrier must be notified of the contents without external labeling indicating a firearm is inside. The Company requires written acknowledgment of receipt from the carrier. Grounds & Rounds LLC will not be liable for any mishaps during the shipping process or receiving process. A tracking number will be provided to the Customer as soon as possible to the email provided in the Customer's profile.

4. Antique Firearms

Antique firearms, as defined by the ATF, do not require shipment to an FFL holder and may be shipped directly to the buyer in standard packaging prepared and wrapped adequately. However, the Customer must verify the item's antique status and provide documentation if requested. Curio & Relic (C&R) licenses are not accepted for modern firearm shipments but may apply to certain antiques. Grounds & Rounds LLC will not be liable for any mishaps during the shipping process or receiving process. A tracking number will be provided to the Customer as soon as possible to the email provided in the Customer's profile.

5. Knives, Air Guns, Accessories, and Gun Parts

These items generally do not require shipment to an FFL holder. However:

• Any part considered a "firearm" by the ATF (e.g., serialized frames or receivers) must be treated as a complete firearm and shipped accordingly.

• All items will be shipped in standard packaging prepared and wrapped adequately.

• The Company will comply with carrier-specific restrictions on hazardous or restricted items.

• Grounds & Rounds LLC will not be liable for any mishaps during the shipping process or receiving process. A tracking number will be provided to the Customer as soon as possible to the email provided in the Customer's profile.

6. Ammunition

Ammunition must be shipped separately from firearms in standard packaging prepared and wrapped adequately. It is treated as hazardous material by many carriers and requires special labeling. Ammunition cannot be shipped via USPS or certain tools like the Grounds & Rounds LLC shipping tool for UPS. The Company will use compliant carriers (e.g., FedEx or UPS via their websites) and ensure adult signature confirmation where required. Grounds & Rounds LLC will not be liable for any mishaps during the shipping process or receiving process. A tracking number will be provided to the Customer as soon as possible to the email provided in the Customer's profile.

7. Carrier-Specific Rules

The Company selects carriers based on the shipment type and Customer preferences, but all must comply with the following (subject to carrier updates; Customers should verify on carrier websites):

7.1 UPS

• Handguns: Next Day Air only, with Adult Signature Required and Direct Delivery.

• Long Guns: Ground service permitted.

• Packaging: Standard packaging prepared and wrapped adequately; no descriptive labeling.

• Ammunition: Additional requirements; labels created on UPS website.

7.2 FedEx

• Licensed Shippers: Permitted; contact FedEx for arrangements.

• Nonlicensee Shippers: Not permitted for firearms.

• Ammunition: Subject to hazardous materials rules.

7.3 USPS

• Nonlicensee: Long guns only (no handguns); intra-state or to FFL; registered mail recommended; no content markings.

• Licensed: Handguns permitted with Form PS 1508; rifles/shotguns with notification.

• Ammunition: Prohibited.

• Packages may be inspected by USPS.

Other carriers generally prohibit firearm shipments.

8. Customer Responsibilities

• Provide accurate information, including FFL copies and recipient details.

• Ensure the shipment complies with all laws; indemnify the Company against violations.

• Pay all shipping fees, including any additional charges for compliance (e.g., adult signature).

• Verify recipient's eligibility to receive the item.

9. Liabilities and Disclaimers

Grounds & Rounds LLC is not liable for any mishaps during the shipping process or receiving process, including losses, damages, or delays caused by carrier actions, regulatory changes, or Customer non-compliance. The Company disclaims all warranties beyond ATF compliance efforts. In case of lost or stolen shipments, the Company will report to the ATF as required. A tracking number will be provided to the Customer as soon as possible to the email provided in the Customer's profile.

10. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the United States and the State of Georgia. Any disputes shall be resolved through binding arbitration in Richmond Hill, GA.

11. Amendments and Severability

The Company may amend this Agreement with notice. If any provision is invalid, the remainder remains enforceable.

Acceptance

By signing below or proceeding with shipment, the Customer acknowledges understanding and agreement to these terms.

Firearm Shipping Assistance

If a firearm needs to be returned to the manufacturer, we are happy to assist in facilitating the shipping process. All firearms being returned must be securely packaged using appropriate materials and boxes to ensure safe transit.

● Purchased From Grounds & Rounds: Please communicate with the manufacturer to obtain a prepaid shipping label before shipping. We will assist in coordinating the shipment once you have the necessary documentation.

● Purchased Elsewhere: If you need to ship a firearm that was not purchased through Grounds & Rounds, please ensure you have completed all communication with the manufacturer beforehand. Additionally, their valid FFL (Federal Firearms License) must be provided to us for shipping purposes. Please communicate with the manufacturer to obtain a prepaid shipping label before shipping. A $40.00 Flat Rate Fee will be applied to your invoice if no label was created and we have to handle the transfer and shipping.
